The Council also questioned whether there would be another vote on the Michael McCarthy nomination. The nomination of Attorney McCarthy was stalled two weeks ago on a vote of 3-3, Lt. Governor Murray was not present to break the tie.
Attorney McCarthy’s nomination appeared to face problems when during his hearing he stated that he would do what he could to assist inexperienced prosecutors if they made an error in a case. He also appeared confused about the standard of proof required for the issuance of a 209a restraining order.
